1. Introduction: These Terms and Conditions (“Terms”) govern your access to and use of the Coach Tactiq platform (“Platform”), operated by Coach Tactiq Pty Ltd (“Coach Tactiq”, “we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Eligibility: You must be at least 18 years of age or have authority to enter into these Terms on behalf of a club, school, organisation, or other entity. You are responsible for ensuring your use of the Platform complies with all applicable laws.
3. Description of Services: Coach Tactiq provides a subscription-based coaching management platform designed to assist coaches, clubs, schools, and sporting organisations in creating and managing training sessions, designing and storing drills and coaching materials, managing teams and player information, recording and tracking performance data, and organising coaching operations. The Platform is a digital organisational tool only. Coach Tactiq does not provide medical advice, professional sports certification, or guaranteed performance outcomes.
4. Account Registration: To access the Platform, you must create an account. You agree to provide accurate, complete, and current information, keep your login credentials secure, not share account access with unauthorised persons, and notify us immediately of any unauthorised use. You are responsible for all activity that occurs under your account.
5. Free Trial: We may offer a 30-day free trial under promotional terms. The trial period begins upon account activation. At the end of the trial, your subscription will automatically convert to a paid monthly subscription unless cancelled before the trial ends. Payment details must be provided at sign-up. We reserve the right to modify or withdraw trial offers at any time.
6. Subscription and Payments:
6.1 Subscription Model: Subscriptions are billed monthly and automatically renew at the end of each billing cycle. You authorise us to charge your nominated payment method for ongoing subscription fees. 6.2 Cancellation: You may cancel your subscription at any time via your account settings. Cancellation prevents future billing, and you will retain access to the Platform until the end of your current billing period.
6.3 No Refunds: All payments are non-refundable except as required under Australian Consumer Law.
7. Pricing Changes: We reserve the right to change subscription pricing at any time. If pricing changes, you will be notified in advance, and the updated pricing will apply from your next billing cycle. Continued use of the Platform constitutes acceptance of updated pricing.
8. User Content and Ownership:
8.1 Ownership of Coaching Materials: You retain ownership of all training plans, drills, session content, and materials that you create or upload to the Platform. Coach Tactiq does not claim ownership of your coaching content.
8.2 Licence to Operate the Platform: You grant Coach Tactiq a non-exclusive, worldwide licence to host, store, reproduce, and display your content solely for the purpose of operating and improving the Platform.
9. Player Data and Responsibility: The Platform allows you to upload and manage player names, contact details, performance data, and images. You are responsible for obtaining all necessary consents, complying with applicable privacy laws, and ensuring appropriate parental or guardian consent where minors are involved. Data is stored securely using reputable cloud infrastructure providers. Our collection and handling of personal information is governed by our Privacy Policy.
10. Acceptable Use: You must not upload unlawful, abusive, defamatory, or harmful content, infringe intellectual property rights, share login credentials, attempt to copy, reverse engineer, or interfere with the Platform, or use the Platform for illegal or unauthorised purposes. We may suspend or terminate accounts that breach these Terms.
11. Data Retention: If you cancel your subscription, your data may be retained for up to seven (7) years. After that period, it may be permanently deleted. You may request earlier deletion, subject to our legal obligations.
12. No Medical or Performance Guarantees: The Platform provides organisational and coaching management tools only. Coach Tactiq does not provide medical advice, guarantee athlete performance improvements, or guarantee injury prevention. All coaching decisions and training implementation are your responsibility.
13. Use at Your Own Risk: Sport and physical activity involve inherent risks. By using the Platform, you acknowledge that you are responsible for assessing the suitability and safety of all training activities. Coach Tactiq is not responsible for injuries, losses, or damages arising from coaching activities conducted using the Platform. Use of the Platform is at your own risk.
14. Limitation of Liability: To the maximum extent permitted by law, Coach Tactiq is not liable for indirect or consequential loss, loss of profits, loss of data, business interruption, or injury arising from coaching activities. Our total liability for any claim is limited to the total subscription fees paid by you in the three (3) months preceding the claim. Nothing in these Terms excludes rights under Australian Consumer Law.
15. Indemnity: You agree to indemnify and hold Coach Tactiq harmless from any claims, damages, losses, or liabilities arising from your breach of these Terms, your misuse of the Platform, injury or loss resulting from your coaching activities, or failure to obtain appropriate consent for player data.
16. Suspension and Termination: We may suspend or terminate your account if you breach these Terms, engage in unlawful conduct, or misuse the Platform. Termination does not relieve you of outstanding payment obligations.
17. Intellectual Property: All Platform software, branding, design, and underlying technology remain the property of Coach Tactiq Pty Ltd. You must not copy, modify, resell, reverse engineer, or create derivative works without our prior written consent.
18. Platform Availability: We aim to provide reliable access but do not guarantee uninterrupted or error-free service. We may modify features, update the Platform, or perform maintenance from time to time.
19. Changes to These Terms: We may update these Terms at any time. Updated Terms will be published on our website. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
20. Governing Law: These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
